I support AB 793 because:
People in California have a constitutional right to privacy in their personal reproductive and other healthcare decisions. However, right now companies can be compelled to reveal the identities of all people who looked up a particular keyword online or drove down a certain street.
People who need reproductive or gender-affirming care find themselves newly faced with a digital surveillance apparatus that could be used against them. AB 793 will prevent unconstitutional digital surveillance that poses an especially grave risk in post-Roe America.
Normal warrants require probable cause to investigate an individual, but reverse demands turn this due process on its head. It’s not just people suspected of wrong-doing, thousands of people can be caught up in a single request. By simply being in a particular place as part of their daily lives, thousands of people have their privacy invaded for no reason at all.
Police dogs disfigure, injure, and kill Californians. The vast majority of people injured are unarmed and many are innocent bystanders.
This bill will stop government entities from requesting reverse warrants, stops courts from issuing them, and ensure strong enforcement to protect our privacy rights.
